Operator

CircleNest is operated by CircleNest LLC ("CircleNest", "we", "us"), a US limited liability company at 8 The Green #13755, Dover, DE 19901, United States. Contact us at contact@circlenestapp.com.

Where CircleNest is available

CircleNest is currently available in the United States only. If you live elsewhere, please don't create an account; we may expand to other countries over time. By creating an account you represent that you reside in a country where CircleNest is offered and that the country you selected at sign-up is accurate. We may rely on that representation when determining which laws apply to your account.

Acceptance

By creating an account or using CircleNest you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the app.

Who can use CircleNest

You must be at least 18 to create your own account. If you're under 18, ask a parent or guardian to add you to their CircleNest household as a kid profile. Parents and guardians may create kid profiles for their children of any age. Children under 13 are not permitted to register or log in on their own; their participation is managed entirely by a consenting parent under our COPPA practices described in the Privacy Policy. Kids aged 13–17 may receive their own in-app login only when invited and configured by a parent.

By creating an account you represent and warrantthat (a) you are at least 18 years old, (b) the information you provide is accurate, and (c) when you add a kid profile, you are the parent or legal guardian of that child or have lawful authority from the parent or legal guardian to do so. We may rely on these representations and may suspend or terminate accounts where they prove to be false.

Your account

You're responsible for keeping your login secure and for the activity that happens under your account. Don't share your password or impersonate others.

SMS / phone sign-in (TCPA)

If you choose phone sign-in, you expressly consent to receive a one-time verification code by SMS from CircleNest or its SMS provider to the number you enter. Message and data rates may apply. Message frequency is limited to codes you request. Reply STOP to opt out of further messages or HELP for help. Consent to receive verification SMS is not a condition of any purchase; you may instead sign in with email.

Acceptable use

• No harassment, hate speech, or unsafe behavior toward children.
• Don't upload illegal content or anything that violates someone's privacy.
• Don't try to break, scrape, or abuse the service.
• Profanity and sexually explicit language are not allowed in names, descriptions, messages, household list items, kid requests, future letters, or any other user-created content.

We may suspend or remove accounts that violate these rules.

Abuse protection & rate limiting

We apply rate limits and automated abuse protections at the network edge to block bot traffic, denial-of-service attempts, and other abusive request patterns before they reach the app. If your traffic is mistakenly blocked, contact us and we will review.

Repeat connection requests. If another family declines a trusted-family request from you, we keep that decline private and do not notify you that it happened. After a small number of declines from the same recipient, further requests from you to that recipient are temporarily paused so a person who isn't interested isn't pressured by repeated asks.

Keeping kids safe

Kids only appear in circles, plans, and chats with adults a parent has approved. These trust gates are designed to be enforced at the data layer, not only in the interface. Each kid is automatically placed in an age tier (under 13, 13–15, 16–17, then graduating to an adult account at 18) based on their date of birth. Some features are unlocked, locked, or limited automatically by tier, and by the region settings of the parents and co-parents who manage the kid. Tier promotions on a birthday require the primary parent's approval before any new capability is unlocked.

Kid-initiated requests (e.g. a playdate ask) are always routed to the kid's own parent first for approval. Another family is never contacted directly on a kid's behalf, and a kid is not shown whether a parent approved, declined, or did not act on the request — a silent decline is always valid. Lockscreen notifications to a kid device never include message content, and kid devices are silenced during a nightly quiet window in the kid's local time. Notifications to children under 13 are blocked entirely.

Where a parent enables the group schedule, a child may read the title, date, time, place (where the plan shares it with them) and cancelled state of plans they are included in in that circle. This is a parent-granted, read-only capability: it creates no new contact path, sends no notification to the child, and the parent can withdraw authorization at any time; withdrawal takes effect immediately.

Where a parent enables it for a child aged 13 or over, that child may read, and if the parent chose can write may write plain text in, one designated circle conversation. This is a parent-granted capability with three settings — off, can read, can write — and it defaults to off. It creates no direct-message path, no trusted-adult relationship and no other new contact path, sends the child no notification, and gives the child no authority over plans, rides, consent or any other household decision. A qualifying parent in the child's family retains the ability to read that exact conversation; when a parent turns the setting off, or that parent’s ability to read that conversation ends, the child’s access stops immediately. Eligibility also depends on the region settings of the adults who manage the child. This is a mixed adult and teen conversation: our acceptable-use rules apply to everyone in it, any participant can report a message, and we may remove content or withdraw access in response.

PIN attempts on a kid device are rate-limited so casual guessing triggers a short cooldown.

Co-parents, trusted adults, and caregivers

A primary parent may grant co-parent access to a spouse, partner, or legal guardian. When you invite a co-parent into your household you can also pick an optional relationship label (partner, spouse, legal guardian, or other). The label is a personal description used in friendly copy across the app and does not change anyone's permissions. Co-parents share parental authority for that kid. Sensitive actions a co-parent takes (such as removing a trusted family, leaving or removing the kid from a circle, or revoking a previously-granted capability) can be paused for a short hold so the primary parent or another co-parent has a chance to weigh in before they take effect. Demoting a co-parent and certain other changes include an in-app appeal window. If a co-parent resets a kid's PIN, the primary parent is notified and may revert the reset for a short window after. Co-parents are hidden from other families' rosters by default until the primary parent confirms their visibility.

A primary parent may also grant trusted-adultaccess to a stepped-back parent, step-parent, live-in grandparent, or similar permanent family figure. A trusted adult can see the kid's schedule, household notes, the chat threads they are included in, the family memory wall (milestones, kid art, future letters, yearbooks, timeline journal), and the caregivers list, but they cannot change kid settings, approve requests, grant other adults, queue sensitive actions, or act as a parent. The grant is permanent until the primary parent removes it, and a full co-parent may be stepped down to trusted-adult at any time by the primary parent.

A primary parent may also grant time-bounded caregiver access (e.g. relative, nanny, sitter, helper, school staff). Caregiver grants are read-mostly and scoped to what is needed to actually care for the kid during the window: basic profile, safe places (drop-off, allergies), and the plan chats the caregiver is staffed on. Caregivers do not see the family's private memory wall (milestones, kid art, future letters, yearbooks, timeline journal). Access expires automatically at the end of the window or sooner if it goes unused. A caregiver is never a co-parent and cannot take parental actions.

Activity log

CircleNest keeps an internal audit log of sensitive actions on kid profiles (creation, deletion, PIN changes, device revokes, COPPA data deletions, tier-transition decisions, co-parent grants and destructive-action decisions), and of drafts proposed by the in-app AI Assistant (plans, series, messages, or RSVPs it suggests). This log is used only by CircleNest operators to investigate safety and abuse reports; it is not shared with other families.

Plans, RSVPs & FYI sharing

Plans (events) have three visibility layers: Private (just you and your household), Shared (invited families can see and reply), and Household FYI (a read-only copy that appears on the calendars of households you choose — usually your co-parent's household or a trusted family — so they know it's on your plate). FYI copies do not allow replies, chat, or roster edits, can be hidden by the recipient, and are removed automatically if the underlying connection is removed or the plan is deleted.

When a kid is invited to a plan, the kid's parents and co-parents share a single RSVP. Either adult with parental authority can reply on the household's behalf; the most recent reply wins and is mirrored to the other adult(s). We record who replied and when, so co-parents can see at a glance who handled it.

Guest plan links

For adult-only plans, you may generate a public link so people who aren't on CircleNest can reply. Guest links are not available for any plan with a child attached. A guest link is deliberately limited: read the plan, reply once, and optionally add it to their own calendar. There is no guest chat, no photos, no free-form notes, and no view of other people's replies.

Guest links expire. A link stops working 14 days after the plan ends, or sooner if you revoke it or delete or archive the plan. If you mark a place as private, guests see “Private location” and the place is only revealed after they reply, and only if you enabled that. When you change the time or place of a shared plan, guests are not notified automatically — CircleNest prompts you to reshare the updated summary, and sending it remains your choice.

You are responsible for who you send a guest link to and for the contact details you collect through it.

Parent peek (read-only view of a kid's day)

From a kid's profile, an adult with parental authority can open a "Parent peek" — a read-only summary of that kid's upcoming plans, open jobs, and pending requests. Parent peek does not show the kid's private chats, drawings, notes-to-self, PIN, or any other private surface, and it does not bypass kid-mode PIN protection on the kid's own device. It is a parent convenience, not a surveillance tool.

Shared timelines & yearbooks

Timeline entries are private to the author by default and can optionally be shared, at the moment of saving, with adults who share parental authority over the same kid. Yearbook PDFs are generated for adults with authority over the kid in question. CircleNest does not create public, link-based shares for timelines or yearbooks — there is no URL you can send to someone outside CircleNest that will open a kid's timeline or yearbook.

Every household includes one yearbook at no cost; additional yearbooks are part of CircleNest Plus. A yearbook we store for you is available to re-download for 30 days, after which the stored file is removed — the timeline entries it was built from are not affected and the yearbook can be built again. To keep costs predictable there is a fair-use limit on how many times the same yearbook can be rebuilt in a 30-day period; a build that fails doesn't count against your allowance. Yearbooks and keepsakes are keepsake documents, not an archival or backup service — please keep your own copy of anything you want to preserve.

Future letters

Future letters are written by you today and held until an unlock month you choose, up to 50 years from the month you write the letter. Future letters are personal notes — not a substitute for legally binding, time-critical, or safety-critical messages, and we don't promise permanent preservation or guaranteed delivery.

How long a letter is kept follows the lifecycle of the letter itself and of the accounts and profiles it depends on, rather than a blanket promise. In practice:

• You delete a letter — it stops being available and is removed on our ordinary deletion schedule, along with any photo attached to it. Only the letter's author can delete it.
• Delivery is cancelled in review — if you lose guardian authority for a child, your still-undelivered letters to that child pause, and another current guardian can either keep them or end their delivery. If nobody acts within 90 days, delivery ends by default. Ending delivery is not the same as deleting or erasing your content: the letter stops being delivered, and it stays yours.
• An account is erased — erasure follows our account-erasure process. Undelivered letters written by that account are erased with it; a pending letter doesn't create an extra retention period.
• The child's profile is deleted — letters written for that child are deleted with the profile.
• A child becomes an adult — the child account's controls end, and letters already written for them stay valid. They can read them when the unlock date arrives.
• A household closes — closing a household does not by itself delete a letter, and it does not create or preserve anyone's access. A letter stays visible only to people who still have their own valid access to it.

Pets

You can add pets to your household profile so co-parents, caregivers, and trusted-adult grantees know who lives with you. Pet entries are descriptive only — they do not have logins and we do not collect veterinary records or any independent data about the animal beyond what you type into their profile. You are responsible for the accuracy of pet information you share with people helping with your home.

Archiving a kid profile

Archiving a kid profile pauses kid mode, future letters scheduled for them, caregiver and trusted-adult grants, and any outbound surfaces tied to that kid. The profile is hidden from family pages but no data is deleted. You can unarchive at any time. Deleting an archived profile from Trash follows the standard 30-day recoverable-deletion window. If the archived kid has a co-parent, that co-parent is notified that the profile was archived; either parent may unarchive.

Legacy contacts & memorialization

You may nominate an adult CircleNest user as your legacy contact. They must accept the role. If something happens to you, a legacy contact, a household co-parent, or a verified next of kin may open a memorialization request through the in-app flow. We require appropriate documentation (such as a death certificate or court order) before any memorialization action is taken.

A legacy contact does not get login access to your messages, notes-to-self, "Us 💛" thread, or timelines while you are alive, and does not gain that access after memorialization. What they can do is narrow and described in the Privacy Policy: pause or cancel scheduled future letters, help coordinate a hand-off of kid profiles you parent, and request that the account be set to a memorialized state. Co-parented kid profiles are not deleted on memorialization — primary-parent status transfers to the surviving co-parent so the kid's profile stays intact.

Memorialization is a service we provide on a reasonable-efforts basis. We are not a probate court and we are not a substitute for an estate plan; for legally binding instructions about your digital assets, please consult an attorney.

Household lists

Items you add to your default shopping list or to custom household lists are visible to all members of your household. Requests your kids send may be accepted into the default shopping list by an adult. You are responsible for the content you add to lists.

Chat, voice notes, kid art & retention

Chat text messages are retained for 2 years from when they were sent, then automatically deleted. Messages you mark as "Keep" (saved) are exempt and stay until you unsave or delete them. Chat photos and file attachments are deleted from our storage after 365 days; an "Attachment expired" placeholder remains for up to 90 more days before the message row is purged. Saved attachments are exempt. Event group chats are purged 30 days after the plan's date, regardless of the 2-year floor. Voice notes in chat are limited to 60 seconds and are automatically deleted from our servers after 30 days. Kid art drawings a kid sends from kid mode are only visible to adults with authority over that kid, and any drawing that is not explicitly saved to the kid's timeline is automatically deleted after 90 days. A teen (age 13+) may also see their own drawings from the last 30 days inside Kid Mode; that view is read-only, contains no save or hide indicators, and shows only the teen's own sends. "My Goals" is a private, self-owned surface for young people aged 10 and over: they may write a goal, a few steps, and an optional target date, and mark items done. It is visible only to that young person — there is no parent view, no notification, no reminder, and no scoring or progress measurement — and the entries are kept until the young person deletes them or the account is removed. "Us 💛"is an optional 2-person space for adult household co-members that exists only when both adults choose it: one adult asks, and the space is created only if the other adult accepts. CircleNest does not create it from relationship labels, co-parenting arrangements, or household shape, and creating it does not define, verify, or legally characterize any relationship. It confers no legal privilege and is not a legal, therapeutic, emergency, or dispute-resolution service. It is kept separate from family chat and every other view, and we do not generate counts, streaks, or comparisons from it. Either adult may close it at any time without the other's permission; closing stops new messages and changes nothing about household membership, parenting roles, or any other conversation. Closing is not deletion — content already shared follows the normal retention, export, and deletion rules described in these Terms. If one party later leaves the household, the space is sealed — read-only for both sides, with no new messages and no further visibility for the leaver; sharing a household again later does not reopen it, and a space that has ended is never reopened. Love taps(a small heart you can send a kid) carry no text content and are not counted or streaked.

External links. CircleNest does not endorse or review websites linked in chat messages. External sites are not under our control and may have their own terms and privacy practices.

Moments, Vibes & Free to meet (adults only)

Moments are short photo posts (up to 4 photos with an optional caption) shared with your trusted families. Moments expire automatically — 7 days by default, and the author may extend the expiry once, up to a hard ceiling of 14 days from when the moment was first created. After expiry the moment, its photos, and any reactions are deleted.

Vibes are a 24-hour ambient status. Each user picks a single default audience (your circles or your trusted families) in Settings; the composer does not show an audience picker. Reactions to a vibe are private from sender to recipient, with no counts and no viewer lists. Vibes auto-clear after 24 hours and produce no notifications.

Free to meet windows are a coarse signal that your household is free for a window of time (e.g. "this afternoon", "this weekend"). Inside CircleNest they are visible only to your accepted trusted families while the window is live, expire automatically, and send no notifications. We do not store location or precise times on these windows.

Free-to-meet guest links. You may also choose to share a single free window or ask as a link with an adult who has no CircleNest account. If you do, that person sees only: a household label, the bounded window, and any one-line note you typed. They never see your address, your kids, your circles, your other availability, or who else replied. They can reply "we're free too," "maybe," or "can't this time" and nothing else. These links are revocable at any time and expire automatically at the end of the window plus a short grace period. A reply never creates a plan on its own — you always confirm. You are responsible for who you send a link to.

Moments, Vibes, and Free to meet are adult-only surfaces for authoring. Kids never author them, and a free-to-meet guest link never discloses anything about a child. Teens (13+) may see their own household's Free to meet windows and those of already- connected trusted families, read-only, with no notifications.

Kid event actions (own-parent routing)

In Kid Mode, eligible kids can tap Say thanks 💛for up to 48 hours after an event ends. The thank-you is delivered to adults in the kid's own household — it is never sent directly to the host family. There is no host-side counter, no "X kids thanked you" surface, and no forward button.

Kids may also privately mark themselves "excited" or "unsure" on an upcoming event. These signals are visible only to the adults with parental authority over that kid (primary parent and active co-parents); hosts, other families, caregivers, and trusted adults never see them. No notifications are sent when a signal is set or cleared.

Organizer mode for circles

A circle creator may turn on organizer mode to run a team, class, or other small group from inside the circle. With organizer mode on, the circle gets pinned announcements, a "paste roster" bulk-invite tool, and per-kid yes/no on plans run from the circle. The creator can promote any member to co-organizer; co-organizers can post announcements, invite families, and edit the circle's name, emoji, and cover, but cannot delete the circle or remove the creator. Organizer mode can be turned off at any time and the related surfaces are hidden again.

Kid allowances

A primary parent or co-parent may restrict any single capability for a kid (for example, free-text chat or voice notes) from the kid's Controls → Allowances. Adding a restriction takes effect immediately. Lifting a restriction is immediate when the primary parent does it; when a co-parent lifts a restriction it is queued for the standard 48-hour hold so the primary parent has a chance to review.

AI Assistant

The optional in-app AI Assistant is currently on probation: it may be changed, limited, or removed based on evidence and cost review. When you send it a prompt, only your prompt and a small set of read-only app context (such as your circles, upcoming plans, and open conversations) are routed through an AI gateway to third-party AI model providers. The Assistant does not read the contents of your family chats, notes-to-self, "Us 💛" thread, timeline entries, photos, drawings, or future letters.

The Assistant returns structured drafts — for example, a proposed plan, series, message, or RSVP. It cannot write anything directly to your account. A human must review and confirm every draft before it is saved, sent, or posted. Use is capped per user, per household, and app-wide, and a master kill switch can disable it at any time.

AI output is informational only and is not professional, medical, legal, or safety advice. Don't include sensitive personal information in prompts. Under our gateway agreements, providers process requests to return a result and do not use them to train models.

Reports & moderation

You can report content or users you believe violate these Terms. We review reports and may remove content or suspend accounts. Reporter identity is kept confidential to our moderation team.

Notifications & reminders

If you opt in to push notifications, we'll send plan reminders, invites, and chat alerts to your device. You can turn them off any time from Profile → Notifications or in your browser settings.

You can also ask for a Week Ahead summary and, per occurrence, a reminder about an event that came from a calendar you connected, imported or subscribed to. Those calendars remain the source of truth: CircleNest reflects what the calendar provides at the time it is read, and a reminder is dropped if the occurrence is no longer there. Summaries and reminders are a convenience, not a guarantee — delivery depends on your device, browser, network and the calendar provider, so please don't rely on them as the only record of something time-critical.

Error reporting & analytics

To keep the app stable, crash and error data (stack traces, browser info, page URL, IP address) is sent to our error-monitoring provider. We configure this tool to exclude plan content, messages, and kid profile data, although it is possible that user-supplied text incidentally captured in a stack trace could be received.

We also collect product analytics (page views, feature usage, conversion funnels) via a third-party analytics provider to understand how people use the app and improve it. We configure this tool to exclude messages, plan content, and kid profile data.

Service "as is"

CircleNest is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted or error-free operation, or correction of defects. We do not warrant that the service will meet your requirements or achieve any particular outcome.

Limitation of liability

To the maximum extent permitted by applicable law, CircleNest LLC and its officers, members, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the service, even if advised of the possibility of such damages.

Cap on direct damages. Our total aggregate liability to you for all claims arising out of or relating to these Terms or the service will not exceed the greater of (a) the amounts you paid CircleNest LLC for the service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you; in those jurisdictions our liability is limited to the smallest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless CircleNest LLC and its officers, members, employees, agents, and service providers from and against any third-party claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your content, (b) your use or misuse of the service, (c) your violation of these Terms or of any law or third-party right, or (d) your representations about your age, your relationship to a kid you add, or any other information you provide. We may, at our option, assume the exclusive defense and control of any matter otherwise subject to your indemnification, in which case you agree to cooperate with our defense.

Force majeure

CircleNest LLC is not responsible for any failure or delay in performing its obligations under these Terms to the extent caused by events beyond our reasonable control, including without limitation acts of God, natural disasters, war, terrorism, civil unrest, government action, public-health emergencies, labor disputes, internet or telecommunications outages, power failures, or failures of third-party hosting, cloud, or network providers.

Plans, pricing & subscriptions

CircleNest offers a Free plan and a paid subscription called CircleNest Plus. Plus is sold per household. Current list prices are shown in the app at the point of purchase; at the time of this version they are $4.99 per month or $44.99 per year (USD, plus any applicable tax). Prices in other currencies and any promotional price are displayed at checkout and govern that purchase.

What Plus changes. Plus increases capacity — for example household storage (currently 2 GB on Free and 10 GB on Plus) and the number of Future Letters you can have scheduled at one time (currently 3 on Free and 20 on Plus). Plus is not required to coordinate with other families, to be invited, to reply, or to reach content you already created. Stated allowances are the allowances in effect today, not a permanent entitlement.

Automatic renewal & cancellation. Subscriptions renew automatically at the end of each billing period at the then-current renewal price for your plan until cancelled. You may cancel at any time; cancellation takes effect at the end of the period you have already paid for, and Plus capacity ends then. Refunds are handled as described in our Refund Policy and by Paddle.

Founding Family pricing. Where offered, a Founding Family price applies to the first year only and then renews at the then-applicable standard renewal price for the annual plan (currently $44.99 per year). Founding Family is a price, not a separate product tier or a permanent discount, and eligibility is limited and may close at any time.

Price changes. We may change prices, introduce or retire plans, and change what is included in a plan. A price change affecting an existing subscription applies to future billing periods only, and we will give you notice before it takes effect (by in-app notice or email) with an opportunity to cancel. Nothing in these Terms promises that any price, plan, tier, or allowance will remain available indefinitely.

If Plus ends. Ending or losing Plus does not, by itself, delete content you already created: existing memories, plans, photos, and letters remain viewable to the people who could already see them, subject to these Terms, the retention periods in our Privacy Policy, and account deletion. What changes is future capacity — new uploads and newly scheduled letters are limited to the Free allowances, and creation may be paused while your household is above a Free limit. We do not delete over-limit content solely because a subscription ended, but we may cap how far storage can exceed the Free allowance and may require you to reduce usage before adding more.

Purchases through an app store. If you subscribe through Apple or Google rather than through our website, that store's billing, renewal, cancellation, and refund rules apply to the purchase, and you manage or cancel the subscription in that store's account settings.

Billing is separate from access. Subscription status never determines household membership, parental or relationship authority, or who may access family data they were already authorized to see.

Service availability & product changes

CircleNest evolves. Subject to applicable law, we may add, modify, replace, limit, suspend, or discontinue features and integrations; change Free and Plus entitlements, quotas, rate limits, and storage allowances; introduce or retire plans and tiers; change which devices, browsers, operating systems, and app versions are supported; change which countries or regions CircleNest is offered in; and end experimental, beta, or early-access functionality.

Where a change is material and significantly reduces functionality you actively use, or where notice is required by law or affects an existing paid subscription, we will provide notice by in-app notice or email. If we discontinue the service, we will make a reasonable effort to provide a period in which you can export or delete your data first.

We do not guarantee uninterrupted, timely, error-free, or continuously available operation. Outages, maintenance, device and network failures, delayed or undelivered notifications, third-party outages, synchronisation delays, unsupported or out-of-date app versions, and security-related suspensions can all occur.

What “private” means here

When the app calls something private — a note to self, a Keep, a “Us 💛” thread, a kid’s drawing — we mean it is visible only to the audience that feature defines, and we design those boundaries to be enforced at the data layer. It does not mean end-to-end encryption, and it is not a promise that no system or person can ever process the content: our infrastructure and service providers necessarily store and transmit it, a small number of authorised personnel may access it where strictly necessary to operate, secure, or support the service, and we may process or disclose content where required by law or to respond to a credible safety risk. The Privacy Policy describes these cases.

Third-party services, platforms & integrations

CircleNest works alongside services we do not control — calendar providers, operating-system share and media features, email and messaging apps you paste links into, push-notification services, payment processors, app stores, and hosting and infrastructure providers. Those services are governed by their own terms and privacy practices, and their availability, behaviour, and pricing are outside our control. We are not responsible for their independent operation, and we may add, change, or remove an integration at any time; the loss or change of a third-party integration is not a breach of these Terms.

If you use CircleNest through an app store, you also agree to that store’s terms. The store is not a party to these Terms and is not responsible for CircleNest or for providing support for it.

Backups, export & your own copies

We keep operational backups and use recovery practices intended to protect against system failure, and you can export your data from Profile → Account → Export my data. These are service capabilities, not a contractual backup guarantee.

CircleNest is not an archival or camera-roll backup service. Photos you upload are optimised for sharing and are not stored as your original camera files, some content expires on the schedules described in the Privacy Policy, and deletion is real. Please keep your own copies of anything irreplaceable.

Changes to these terms

We may update these Terms as the app, our pricing, or applicable law evolves. When we make material changes we'll update the date above and ask you to re-accept on next app load. Continued use after that means you agree to the updated Terms.

Ending your account

You can delete your account at any time from Profile → Settings → Sign in → Delete account. When you request deletion, we hold your account for a 30-day grace period during which you can sign back in and cancel. After the 30 days, your profile, hosted plans, circles you created, and messages you sent are erased. Kid profiles you parent who have no other parent on the account are erased with your account; kids with a co-parent are not deleted — primary-parent status is transferred to the co-parent so the kid's profile, circles, and history stay intact. Encrypted database backups may retain a copy briefly before being overwritten on their normal rotation. See the Privacy Policy for full retention details.

Our intellectual property

CircleNest, the CircleNest logo and nest mark, the in-app visual identity, the app's screens, copy, illustrations, and source code are owned by CircleNest LLC and are protected by copyright, trademark, trade-dress, and patent laws.

Patents. Patent Pending. No patent rights are granted to you by these Terms.

Trademarks. "CircleNest", the CircleNest logo, "Us 💛", "Kid Mode", and other product names and marks used in the app are trademarks of CircleNest LLC. US federal registration of one or more of these marks is planned or in progress; until a mark is registered we use the ™symbol. Nothing in these Terms grants you any right to use our names, logos, or other brand assets except for accurate, non-misleading reference to the service.

Copyright. All app content created by CircleNest is © 2026 CircleNest LLC. You may not copy, scrape, mirror, reverse-engineer, or republish the app, its screens, or its content except as expressly allowed by these Terms or by applicable law.

Your content. You keep all rights to the messages, photos, drawings, lists, letters, and other content you upload to CircleNest. You grant CircleNest a limited, worldwide, royalty-free license to store, display, transmit, back up, and process that content solely to operate the service for you and the people you've shared it with. We do not sell your content, use it for advertising, or use it to train AI models.

Feedback. If you send us suggestions, bug reports, or feature ideas, you grant us a non-exclusive, royalty-free, perpetual license to use them to improve CircleNest, without obligation to you.

Copyright & DMCA

We respect intellectual property rights. If you believe content on CircleNest infringes your copyright, send a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to our designated agent that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material to be removed and information sufficient to locate it; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized; and (6) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the rights owner.

Governing law

These Terms and any dispute arising out of or relating to them or your use of CircleNest are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Binding arbitration & class-action waiver

Please read this section carefully — it affects your legal rights.

You and CircleNest LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the service (a "Dispute") will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either party may bring an individual action in small-claims court for disputes within that court's jurisdiction. Arbitration will be conducted in English, in Wilmington, Delaware, or remotely if the arbitrator permits. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

Class-action waiver. You and CircleNest LLC each agree that Disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

30-day opt-out. You may opt out of this arbitration agreement by sending written notice to contact@circlenestapp.comwithin 30 days of first accepting these Terms, including your name, the email on your account, and a clear statement that you wish to opt out. Opting out does not affect any other part of these Terms.

If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and brought in the courts identified under "Governing law" above; the remainder will proceed in arbitration.
